BPO Union questions Evalueserve HR practices

How long should a working shift last without paying over-time?

BPO Union wants to question Evalueserve (EVS for short) HR practices. We received information from a few ex-EVS employees last week and we decided to check. Initially it was difficult to believe that EVS, a path breaking KPO of exceptional repute, would do anything out of line. Still we made up our minds to investigate the matter at depth.

This is what surfaced on preliminary findings:

  • Secondary information from serving and ex-EVS employees confirmed that the company offers a 10 hr shift, with a 1 hr break for food/ rest.
  • The above fact is communicated to aspiring employees during the interview stage itself.
  • We did not find out any evidence suggesting payment for over-time beyond the mandatory 8 hr shift of work, which is universally accepted as ‘a-fair-day’s-work-shift’. This must be looked into deeper.
  • The general treatment meted out to employees (by EVS) was acceptable to them.
  • A lot of information to the above effect is already available on various websites/ blogs etc if one were to search for it. Supposedly, most of it posted by EVS themselves (of course on the quiet) or at its behest, but there is nothing wrong indulging in surrogate PR.

Now comes the part where we step in to take action:

  • Looks like the Labor Department in key BPO Cities will be kept busy from now. Hope you remember the IBM Daksh case where they have been taken to court by an ex-employee under violation of Labor Laws. The gentleman sought our support and got it, the issue is still under progress. Braveheart Employee takes IBM Daksh to Labor Court
  • A letter will be sent to the Labor Commissioner to investigate if the current practice is acceptable under legal and policy provisions. If not then a request for stringent action will be made. We shall follow it with other methods to initiate response via immense public pressure.
  • We are yet to get a proper legal scrutiny to the issue. Remember our earliest posts where we told you that a very highly sought after legal mind has agreed to help our cause – well given paucity of time the Lawyer has not yet given us expert opinion, it is expected early next week.
  • The most important point we want to make and the question we want to put up is – Should we be working more than 8 hrs without over-time pay?
  • We are also of the opinion that if Companies are found to violate any law by not paying beyond the 8 hr shift, then they should be made to pay up to all the employees, who in the past have put in extra time, and were not paid for it. We are sure that if this were to happen, any Company Management’s heart would sink at the numbers.
  • If any Company is found guilty in this practice, we will intervene to initiate an enquiry into ALL BPOs (includes KPOs) across the length and breath of our great Country. The dues would run into millions of dollars!
  • One surprising fact came out of this initial exercise – that the probable culprits (if our charge comes out true, and is legally tenable) are a majority of high-end KPOs, and a large part of them is captives of foreign firms.
  • On continuing thought we’ll also seek some clarification from the Labor Ministry, GOI, early next week too.

We invite a debate on this issue, emails preferred (bpounuion@gmail.com). We also invite more friends who’d like to help us with concrete information (or evidence of wrong-doing) by any company on the issue so that we are able to take it up even more strongly.

    Hi,

    First of All Congrats for the tremendous job which is done by BPO Union in helping people to fight and raise their voice. It is something which was required for a long time. I would like to bring to your notice that there are leading companies like Wipro, Deloitte and Genpact alongwith few others where employees are asked to stretch and complete their work beyond the stipulated 9 hrs without any extra package or pay.

    Most of the times this kind of practice is encouraged by the top management who say that overtime is not acceptable but still they encourage and if a employee doesn’t work overtime then he is compared with a outstation guy who wants to spend most of the time in office as he would feel bored in office.

    Dear Friend,

    Why don’t you take a re-look into the laws yourselves.

    And on the other side of the equation pls consider that we are out to change the anomalies. So please prepare yourselves for what is to come rather than fighting over what is going to become irrelevant soon. If something has been followed for a long time please do not assume that it will not be questioned. Incidentally when was the last time you implemented ‘change’ and ‘innovation’, words that your top bosses really like to utter on every occasion?

    Let’s all brace for newer laws if you insist on being adamant.

    Good work BPO/KPO union. It’s not only about working hours the BPO’s are indulging in other malpractices while treating their employees. Most fascinating this is that due to the down turn in the industry the HR is seeing this as an opportunity to vent all their pent up frustrations when dealing with employees.

    This is really a great step… The worst part to this is that, evalueserve emplyoees have a 10 hr shift and they have to sit late for around 3 hrs to finish their work….

    Good work BPO Union… carry on this great work…. these companies are not paying enough to the employees and are violating labour laws….

    Yes,

    Everyone is right, but did you know, Evalueserve has restricted the working hours bryond the limit. any employee if needs to stretch for some urgent client work needs a proper written approval for staying in the office beyond working hours, however, I do agree that there are some instances where in an employee agrees to stay only because his/her immediate superior wants him/her to stay, for an unnecessary reason, some work which the person can complete the next day itself. Also, some employees from outside locations also tend to stretch as they would get bored at home. this thing will change only when the employees change thamselves. They need to stand up and say, “this work is not urgent and so I would complete it tomorrow, and the office hours are done, so, CHAO!! ”

      This is a very idealistic situation which you are talking about here. Evalueserve has a culture of taking up projects without having the manpower and staffing to complete it on the assigned time. In this case, when it is inevitable that the project is going to overshoot its deadline if one does not stretch, a responsible employee would stay back to complete the work. Unfortunately, this kind of situation is a rule than an exception in EVS. So the employee virtually has no say (the management is only interested in the money from the projects).

      To top it all, the company’s premises does not even has its Airconditioning on in its building if an employee stays beyond designated hours!!

      So much for money!!!

    yes Mr. Nitesh, you must be right.

    Evalueserve did have a 8hr working shift 3 years back…and with growing profits. The company suddenly changed it to 10 hr working shift without giving a valid reason to it. All management are known to suppress any negative quetions from coming in….so the rule was placed in order without much of an effort.

    Emplyees who tend to sit back in office in the name of stretching, are actually eating company resources and setting a bad trend for the forthcoming people. A proper written approval for staying in the office beyond working hours is just a cover up, you should go down to see how many such cases are true.

    BPO are covered by Shops and Establishments Act .This Act regulates the working hours.Overtime is also covered there.
